In order to conscientiously implement the notice of the national development and Reform Commission and the Ministry of Commerce on printing and distributing the negative list of market access (2019 version) (fgtg [2019] No. 1685), the provincial development and Reform Commission and the Provincial Department of Commerce, together with relevant provincial departments, have refined the list items and jurisdiction, and formed the negative list of market access (2019 version) implemented by our province. The relevant requirements are hereby notified as follows:
1、 Earnestly implement the list. Strictly implement the management mode of "one national list", and shall not release the negative list of the nature of market access. All kinds of market subjects can enter the industries, fields and businesses outside the list equally according to law. It is not allowed to set up another administrative examination and approval for market access in violation of regulations, so as to ensure that "one order is listed and there is no order outside the order". Each unit shall compare the list one by one, refine the responsibility decomposition, strictly standardize the approval behavior, optimize the approval process, accelerate the establishment of a seamless connection mechanism between the list items and the existing administrative approval process, and avoid the phenomenon of "two skins" between the list items and the actual approval. For rules and regulations and normative documents that do not conform to the spirit of the list, we should formulate procedures according to law and do a good job in the work of "establishing, changing and abolishing".
2、 Accelerate the improvement of the list information disclosure mechanism. The development and reform and commerce departments at all levels shall timely publish the negative list of market access (2019 version) implemented by Zhejiang Province on the portal website, effectively increase the publicity and interpretation and improve the awareness of the list. The provincial competent department shall standardize the name and approval authority of the list items of the system, guide all levels to correctly understand and use the list, and eliminate the inconsistency of the name of the list items, unclear authority, unsmooth operation and other phenomena. The competent departments at all levels shall, in accordance with the reform requirements of "running at most once" and in accordance with the standardized statements of the competent departments at the provincial level, publish the names, processes and handling elements of the listed items, so as to ensure that the market subjects can understand and operate.
3、 We will continue to relax the threshold for market access. All units should establish working mechanisms to promote the removal of unreasonable restrictions and hidden barriers to market access in various forms, and strive to create a stable, fair, transparent and predictable business environment. We should pay close attention to the market reflection, listen to the opinions of market subjects and industry associations through multiple channels, continuously track and pay attention to the fields and industries that can be relaxed during the implementation of the list, put forward opinions and suggestions, and timely submit them to the provincial development and Reform Commission and the Provincial Department of Commerce.
4、 Improve the market access system. All units shall conscientiously perform their duties and earnestly do a good job in the tracking, monitoring, evaluation and improvement of the implementation of relevant approval items of their own units. We should further improve the access mechanism, examination and approval mechanism, in-process and post supervision mechanism, social credit system, incentive and punishment mechanism, commercial registration and other systems suitable for the negative list system of market access, and systematically integrate, coordinate and efficiently promote the reform of the market access system.
