Opinions on Further Strengthening the review and management of fixed asset investment projects and regional energy conservation


In order to implement the "dual control" system of national total energy consumption and energy intensity, further strengthen the review and management of fixed asset investment projects and regional energy conservation (hereinafter referred to as "energy conservation review") and improve energy efficiency, According to the energy conservation law of the people's Republic of China, the measures of Zhejiang Province for the implementation of the energy conservation law of the people's Republic of China, the measures for the review of energy conservation of fixed asset investment projects (Order No. 44 of the national development and Reform Commission) and the guiding opinions of the general office of the people's Government of Zhejiang Province on the comprehensive implementation of the reform of "regional energy assessment + block energy consumption standard" (zhe Zheng Ban Fa [2017] No. 61) And other relevant provisions, we hereby put forward the following opinions.


1、 Define the scope and responsibilities of energy conservation review


For fixed asset investment projects (except civil construction projects) and provincial major high-energy strategic platforms, development zones (parks) and other specific areas constructed within the administrative region of the province, energy conservation review shall be carried out in accordance with the provisions of these opinions.


The competent energy conservation departments of the people's governments at or above the county level shall be responsible for the examination of fixed asset investment projects and regional energy conservation. The funds required by the competent department of energy conservation for the implementation of energy conservation review and in-process and post supervision shall be included in the budget of its own administrative organ and guaranteed by the finance at the same level.


2、 Strengthen the review of energy conservation of fixed asset investment projects


(1) Implement hierarchical and classified management.


The review opinions on energy conservation of fixed asset investment projects are an important basis for project construction, completion acceptance and operation management. Government invested projects shall pass the energy conservation examination before submitting the feasibility study report; An enterprise's investment project shall pass the energy conservation examination before starting construction. The construction unit shall not start the construction of the project that fails to carry out the energy-saving review or fails to pass the energy-saving review as required, and the completed project shall not be put into production or use.


For the fixed asset investment projects examined and approved by the national development and Reform Commission and submitted to the State Council for examination and approval or approved by the national development and Reform Commission, the provincial competent department of energy conservation shall be responsible for the implementation of energy conservation examination.


In addition to the fixed asset investment projects examined and reported by the national development and Reform Commission to the State Council for approval or approval, and the fixed asset investment projects examined and approved by the national development and Reform Commission, the energy-saving examination of the fixed asset investment projects with an annual comprehensive energy consumption of more than 5000 tons of standard coal shall be entrusted by the provincial energy-saving department to the energy-saving Department of the city divided into districts where the project is located. Among them, for fixed asset investment projects with an annual comprehensive energy consumption of more than 50000 tons of standard coal, the local authorities must report to the provincial competent department of energy conservation for examination and confirmation before issuing the reply on energy conservation examination.


For fixed asset investment projects with an annual comprehensive energy consumption of more than 1000 tons of standard coal but less than 5000 tons of standard coal, the competent energy conservation departments of cities and counties (cities and districts) divided into districts shall be responsible for energy conservation examination within their respective scope of responsibility according to their authority, and the specific authority shall be determined by the people's Government of cities divided into districts.


For the fixed asset investment projects in the industry catalogue that are not subject to separate energy-saving review according to the national regulations, and the fixed asset investment projects with an annual comprehensive energy consumption of less than 1000 tons of standard coal, no separate energy-saving review will be conducted. When submitting the feasibility study report, the government invested project shall inform the local energy conservation department of the energy consumption of the project. The enterprise invested project shall inform the local energy conservation department of the energy consumption of the project before starting the construction, and construct according to the energy standards and specifications.


For the fixed asset investment projects entrusted by the provincial competent department of energy conservation for energy conservation examination, the entrusted energy conservation examination organ shall implement the administrative license in the name of the provincial competent department of energy conservation within the scope of entrustment. The entrusted energy conservation examination authority shall report to the provincial competent energy conservation department for record within 10 days after issuing the energy conservation examination opinions.


(2) Clarify the contents of energy conservation report.


The construction unit shall prepare a report on energy conservation of fixed asset investment projects. The energy conservation report shall include the following contents: analysis and evaluation basis; Energy saving analysis and comparison of project construction schemes, including general layout, production process, energy consumption process, energy consumption equipment and energy measuring instruments; Analysis of energy consumption, energy consumption structure and energy utilization efficiency of the project; Implementation of mandatory energy-saving standards for the project; Define the energy consumption (coal consumption) reduction or equivalent substitution scheme; Select energy-saving technologies and management measures with good energy-saving effect and feasible technology and economy; Utilization of renewable energy such as roof photovoltaic; Analyze and evaluate the impact of the total energy consumption and intensity targets and the alternative targets of coal consumption reduction, etc.


For the new energy consumption projects whose energy consumption per unit of industrial added value (industrial added value adopts comparable price, and the power standard conversion coefficient is calculated according to the equal value, calculated by the average standard coal consumption of thermal power generation in the province in the previous year published by the statistical department every year, the same below) is higher than the control target of the whole province, the energy consumption reduction or equivalent substitution measures shall be strictly implemented. For new coal projects, strictly implement the policy of coal reduction or equivalent substitution.


(3) Standardize energy conservation review procedures.


The competent department of energy conservation shall make a decision on acceptance or rejection within 5 working days after receiving the application materials; If the application materials are incomplete or do not conform to the legal form, the applicant shall be informed of all the contents to be supplemented and corrected on the spot or within 5 working days. If the applicant fails to inform within the time limit, it shall be accepted from the date of receiving the application materials.


After the competent department of energy conservation accepts the application materials, the following three types of projects shall entrust relevant institutions or organize expert groups to review and form review opinions as an important basis for energy conservation review. First, textile industry, non-metallic mineral products industry, metal smelting and rolling processing industry, chemical raw materials and chemical products manufacturing industry, petroleum processing coking and nuclear fuel processing industry, papermaking and paper products industry, chemical fiber manufacturing industry, power and heat production and supply industry, 5g network, data center and other high energy consuming projects; Second, projects with an annual comprehensive energy consumption of more than 5000 tons of standard coal; Third, the energy consumption per unit of industrial added value is higher than the provincial control target.


The competent department of energy conservation shall make a decision on whether to approve the administrative license within 8 working days after officially accepting the application materials. If the examination conditions are met, the competent energy conservation department shall issue energy conservation examination opinions; If the examination conditions are not met, the competent energy conservation department shall issue a written notice of disapproval of the administrative license and explain the reasons.


(4) Clarify the contents of energy conservation review.


When examining the energy conservation report of the project, the competent energy conservation department mainly reviews the following contents: whether the project complies with relevant laws, regulations, standards, specifications and policies on energy conservation; Whether the energy consumption analysis of the project is objective and accurate, whether the method is scientific and whether the conclusion is accurate; Whether the energy-saving measures are reasonable and feasible; Whether the energy consumption and energy efficiency level of the project meet the "double control" management requirements of the total energy consumption and intensity of the region.


The review opinions on energy conservation of the project shall include: energy (coal) consumption, energy efficiency level to be achieved, energy consumption (coal) reduction or equivalent balance scheme, implementation of energy conservation measures, relevant suggestions on energy conservation, validity period, etc. The review opinions on energy conservation shall be valid within 2 years from the date of issuance.


In addition to the online examination, approval and supervision of investment projects in Zhejiang Province, the results of investment projects involving investment in energy-saving projects shall be included in the online examination, approval and supervision platform. In addition to the online examination, approval and supervision of investment projects, the results of investment projects involving energy-saving projects shall be included in the online supervision, approval and supervision platform.


3、 Standardize the review and management of regional energy conservation


(1) Implement hierarchical and classified management.


The provincial department in charge of energy conservation is responsible for the regional energy conservation review of major provincial high-energy strategic platforms. In principle, other development zones (parks) and other regions shall be reviewed by the Energy Conservation Department of the city divided into districts.


(2) Clarify the content of regional energy conservation report.


Regional administrative agencies shall prepare regional energy conservation reports. The contents of the regional energy conservation report shall include: regional overview and four to four scope; Current situation of energy consumption, orientation of leading industries and energy consumption standards of major industries; Analysis of energy "double control" and total coal consumption control objectives, as well as new energy consumption (coal consumption) reduction or equivalent substitution schemes; Negative list of energy conservation review of fixed asset investment projects; Countermeasures and measures to improve energy utilization efficiency and reduce energy consumption; Promotion and application of regional advanced energy-saving equipment, processes and technologies; Utilization of renewable energy such as roof photovoltaic; Working mechanism for energy conservation incentives and energy efficiency leaders; Regional annual energy consumption plan, energy consumption monitoring and management, target assessment and accountability, etc.


(3) Standardize regional energy conservation review procedures.


The competent department of energy conservation shall make a decision on acceptance or rejection within 5 working days after receiving the application materials; If the application materials are incomplete or do not conform to the legal form, the applicant shall be informed of all the contents to be supplemented and corrected on the spot or within 5 working days. If the applicant fails to inform within the time limit, it shall be accepted from the date of receiving the application materials.


After accepting the application materials, the competent department of energy conservation shall entrust relevant institutions or organize an expert group to review and form review opinions as an important basis for energy conservation review. The competent department of energy conservation shall make a decision on whether to pass the examination within 20 working days after officially accepting the application materials. If the examination conditions are met, the competent energy conservation department shall issue energy conservation examination opinions; If the conditions for examination are not met, the competent department of energy conservation shall issue a written notice not to examine and explain the reasons.


(4) Implement the regional negative list system.


Implement the negative list management of energy-saving review of fixed asset investment projects in the region. The projects in the negative list of energy-saving review shall be subject to energy-saving review management, and all government investment projects requiring energy-saving review in the region shall be included in the negative list management. The negative list of energy-saving review of provincial fixed asset investment projects is: fixed asset investment projects examined and reported by the national development and Reform Commission to the State Council for examination and approval or approved by the national development and Reform Commission. All localities shall independently establish a negative list for energy conservation review of regional fixed asset investment projects based on the provincial negative list in combination with local development planning and the requirements of "dual control" of energy.


The projects beyond the negative list of energy conservation review shall be subject to commitment filing management. The project investor who promises to put on record shall make a written commitment with legal effect to the energy conservation examination authority in the region before the commencement of the project. The contents of the commitment for filing shall include the following contents: the project conforms to the national and local industrial policies; The energy consumption per unit industrial added value and unit product consumption of the project meet the regional energy consumption access standards; The total energy (coal) consumption and energy consumption per unit of industrial added value of the project meet the requirements of "dual control" of regional energy; The technology, process and equipment used in the project meet the national energy-saving technical standards.


(5) Clarify the content of regional energy conservation review.


When examining the regional energy conservation report, the competent energy conservation department mainly reviews the following contents: whether it is within the specified regional scope; Whether the goal of "dual control" of regional energy and the goal of total coal consumption control are clear; Whether the access conditions for regional industry energy efficiency are clear; Whether the regional negative list is clear.


The contents of the review opinions on regional energy conservation shall include: regional geographical location, planning period, positioning of leading industries and energy consumption standards of major industries, total energy consumption control target, total coal consumption control target, energy consumption intensity control target, negative list of energy conservation review of fixed asset investment projects, energy consumption (coal) reduction or equivalent balance scheme, key energy conservation measures Relevant suggestions on energy conservation, etc.


The validity period of the review opinions on regional energy conservation shall be consistent with the regional national economic and social development plan and the "double control" assessment system of regional energy.


4、 Strengthen the energy-saving acceptance of fixed asset investment projects


Before the fixed asset investment projects that have passed the energy-saving examination are put into production and use, the construction unit shall organize energy-saving acceptance, and the acceptance personnel shall be composed of professional technicians with the ability of energy-saving acceptance. After the project passes the energy-saving acceptance, the construction unit shall inform the energy-saving competent department that issued the energy-saving examination opinions of the energy-saving acceptance report and acceptance opinions within 20 working days. The construction unit shall not put into production or use the project that has not passed the energy-saving acceptance or fails to pass the acceptance, and organize the energy-saving acceptance again after completing the rectification.


The acceptance mainly includes: according to the actual completion of the project, calculate whether the annual comprehensive energy consumption (coal consumption) and energy consumption (coal consumption) balance scheme of the project meet the requirements of energy conservation review; Check whether the main energy efficiency indexes of the project meet the energy-saving review requirements according to the main energy efficiency indexes of the project or the energy efficiency indexes of main processes (devices) determined in the reply of energy-saving review opinions, and according to the performance test data or operation data of the project; Whether the project construction scale, main energy consuming processes, quantity, model and energy efficiency of main energy consuming equipment and general equipment meet the requirements of energy conservation review opinions; Whether the energy-saving technology and management measures of the project implement the requirements of energy-saving review opinions; Whether the allocation of energy measuring instruments of the project implements the requirements of energy conservation review opinions, etc.


For fixed asset investment projects subject to commitment filing management, the competent energy conservation department shall check and accept whether the construction unit meets the commitment filing content before the project is put into production and use; If the inspection and acceptance are inconsistent with the promised contents of the record, it shall be ordered to rectify within a time limit; If it still fails to meet the promised filing content after rectification, the review opinions on energy conservation shall be revoked.


5、 Strengthen supervision during and after the event


(1) Clarify the contents of supervision and inspection.


The competent department of energy conservation shall, in accordance with the principle of "who reviews, who supervises", supervise and inspect the implementation of energy conservation acceptance and energy conservation review opinions of projects, and conduct irregular spot checks on the implementation of energy conservation review opinions of major projects within its administrative region.


The energy supervision institution shall include the projects that have completed the energy-saving acceptance in the administrative region in the current year as special supervision items in the energy-saving supervision plan of the current year or the next year, and focus on checking whether the total energy consumption, energy efficiency level and energy-saving measures meet the requirements determined in the reply to the energy-saving examination opinions.


The competent department of energy conservation shall supervise and inspect the implementation of the review opinions on regional energy conservation, focusing on whether the energy consumption intensity and total energy (coal) consumption break through, whether the items in the negative list are subject to energy conservation review as required, and whether the items outside the negative list are subject to commitment filing management as required. For projects that promise to be put on record for management, the energy supervision institution or regional management institution shall check against the contents of the project commitment to be put on record.


(2) Strengthen follow-up supervision and handling.


If the construction content, capacity scale, energy efficiency level and energy consumption mode of a fixed asset investment project that has passed the energy conservation review have changed significantly, or the annual comprehensive energy consumption exceeds the level specified in the energy conservation review opinions by more than 10%, the construction unit shall submit an application for change to the energy conservation review authority. For fixed asset investment projects that have passed the energy-saving examination by improper means such as splitting projects and providing false materials, the competent energy-saving department shall revoke the energy-saving examination opinions of the project. For projects that fail to implement the requirements of energy conservation review opinions, the competent energy conservation department shall order the construction unit to make rectification within a time limit. If it cannot make corrections or fails to make corrections within the time limit, the competent energy conservation department shall punish it in accordance with the relevant provisions of laws and regulations.


If the construction content and energy efficiency level of a project that is not subject to separate energy-saving review change, resulting in an annual comprehensive energy consumption of more than 1000 tons of standard coal, the construction unit shall apply for energy-saving review.


The implementation of regional energy assessment shall be included in the annual "double control" assessment of provincial and municipal energy and the comprehensive evaluation of "Heroes per mu" of development zones (parks). Carry out regional energy assessment, implement mid-term assessment, and make the results public to the public in due time. If the region has exceeded the annual energy consumption intensity control target for two consecutive years and it is difficult to achieve the goal of "dual control" of energy in the planning period after comprehensive evaluation by the competent energy conservation department, the review opinions on regional energy conservation shall be revoked.
