Ecological environment departments (bureaus) of all provinces, autonomous regions and municipalities directly under the central government, and Ecological Environment Bureau of Xinjiang production and Construction Corps:
In order to fully implement the decision and deployment of the Fifth Plenary Session of the 19th CPC Central Committee on accelerating green and low-carbon development, resolutely curb the blind development of high energy consumption and high emission (hereinafter referred to as "two high") projects, and promote green transformation and high-quality development, the following guiding opinions are put forward on strengthening the source prevention and control of ecological environment of "two high" projects.
1、 Strengthen zoning management and control of ecological environment and planning constraints
(1) Further implement the "three lines and one order". Ecological and environmental departments at all levels should accelerate the application of the achievements of "three lines and one order" in the industrial layout and structural adjustment of "two high" industries and the location of major projects. When local eco-environmental departments organize the implementation refinement and subsequent update and adjustment of "three lines and one order" cities, they should deepen the environmental access and control requirements of "two high" projects in the eco-environmental access list; Areas undertaking industrial transfer such as iron and steel and electrolytic aluminum should strictly implement the zoning control requirements of ecological environment and take the bottom line of environmental quality as a hard constraint.
(2) Strengthen the effectiveness of planning environmental impact assessment. Ecological and environmental departments at all levels shall strictly review the environmental impact assessment of relevant comprehensive plans and special plans for Industry and energy related to the "two high" industries, especially the plans revised for the launch of the "two high" projects. In the environmental impact assessment review, they shall strictly control the development scale of the "two high" industries and optimize the planning layout, industrial structure and implementation sequence. The environmental impact assessment of the park planning with "two high" industries as the leading industries should increase the analysis of carbon emission and emission reduction potential, so as to promote the green and low-carbon development of the park. Promote the follow-up evaluation of the planning environmental impact of coal power energy base, modern coal chemical industry demonstration area and petrochemical industry base, improve the ecological and environmental protection measures and optimize and adjust the planning in time.
2、 Strict EIA approval of "two high" projects
(3) Strictly control the environmental access of construction projects. The new construction, reconstruction and expansion of "two high" projects must comply with the laws and regulations on ecological and environmental protection and relevant legal plans, and meet the requirements of total emission control of key pollutants, carbon emission peak target, ecological environment access list, environmental access conditions of relevant planning EIA and construction projects in corresponding industries, and the approval principles of EIA documents. Petrochemical and modern coal chemical projects should be incorporated into the national industrial planning. New and expanded petrochemical, chemical, coking, non-ferrous metal smelting and flat glass projects shall be located in industrial parks established in accordance with laws and regulations and subject to planned environmental assessment. The ecological and environmental departments and administrative examination and approval departments at all levels shall strictly control, and those that do not comply with relevant laws and regulations shall not be examined and approved according to law.
(4) Implement regional reduction requirements. For the newly-built "two high" projects, in accordance with the requirements of the notice on strengthening the supervision and management of regional reduction measures for construction projects in key industries and according to the regional environmental quality improvement objectives, formulate supporting regional pollutant reduction plans, take effective pollutant regional reduction measures and free up sufficient environmental capacity. New coal consumption projects in key areas of national air pollution prevention and control (hereinafter referred to as key areas) shall also take alternative measures for coal consumption reduction in strict accordance with the regulations, and high polluting fuels shall not be used as alternative measures for coal reduction.
(5) Rational division of powers. The provincial ecological environment department shall strengthen the supervision and evaluation of the approval procedures and results of the environmental impact assessment of the "two high" projects at the grass-roots level, and adjust and collect in accordance with the law if the approval ability is not suitable. For oil refining, ethylene, iron and steel, coking, coal chemical industry, coal-fired power generation, electrolytic aluminum, cement clinker, flat glass, copper, lead, zinc and silicon smelting and other project categories with great environmental impact or high environmental risk, it is not allowed to arbitrarily release the environmental review and approval authority or reduce the approval requirements in the name of reform pilot.
3、 Promote the coordinated control of pollution and carbon reduction in "two high" industries
(6) Improve the level of cleaner production and pollution prevention and control. The new construction and expansion of "two high" projects shall adopt advanced and applicable process technology and equipment, the material consumption, energy consumption and water consumption per unit product shall reach the advanced level of cleaner production, and the measures to prevent and control soil and groundwater pollution shall be formulated and strictly implemented according to law. Construction projects in "two high" industries with ultra-low emission requirements issued by the state or local governments shall meet the ultra-low emission requirements. Encourage the use of clean fuels. In principle, no new coal-fired self provided boilers will be built for construction projects in key areas. Encourage the transformation of blast furnace converter long process iron and steel enterprises in key areas into electric furnace short process enterprises. Bulk materials are preferentially transported by railway, pipeline or waterway, and short-distance connections are preferentially transported by new energy vehicles.
(7) Incorporate the carbon emission impact assessment into the environmental impact assessment system. Ecological and environmental departments and administrative examination and approval departments at all levels should actively promote the EIA of "two high" projects, carry out pilot work, and connect and implement the policy requirements of relevant regional and industrial carbon peak action plans, clean energy substitution, clean transportation, total coal consumption control and so on. In the environmental impact assessment work, the source item identification, source strength accounting, feasibility demonstration and scheme comparison of pollution and carbon reduction measures of pollutants and carbon emissions shall be carried out in an overall manner, and the optimal scheme of collaborative control shall be put forward. Regions and enterprises with conditions are encouraged to explore and implement the pilot and demonstration of collaborative treatment of pollution reduction and carbon reduction and carbon capture, storage and comprehensive utilization projects.
4、 Strengthen supervision and law enforcement according to pollutant discharge permit
(8) Strengthen the management of pollutant discharge permits. During the examination and issuance of pollutant discharge permits for "two high" enterprises, local ecological and environmental departments and administrative examination and approval departments shall comprehensively verify the implementation of various ecological and environmental protection measures and regional reduction measures in the EIA and reply documents, strengthen on-site verification for the "two high" enterprises that implement the key management of pollutant discharge permits, and refuse to permit those that do not meet the conditions according to law. Strengthen the inspection on the quality of pollutant discharge permits and the submission of implementation reports of "two high" enterprises, and urge enterprises to do a good job in account records, implementation reports, self-monitoring, environmental information disclosure and so on. For the "two high" enterprises with rectification matters in the notice of rectification within a time limit or the pollutant discharge permit, they shall closely track the implementation of the rectification. If they find that they fail to complete the rectification on schedule and have unlicensed pollutant discharge, they shall be strictly investigated and punished according to law.
(9) Strengthen law enforcement and supervision based on pollutant discharge permits. Local ecological and environmental departments should bring the "two high" enterprises into the "double random and one open" supervision. Strengthen the inspection of "two high" enterprises' emission according to the permit and the disclosure of environmental information according to law, especially for the "two high" enterprises that implement the key management of emission permit, timely check the implementation of the matters of emission permit, and focus on the implementation of the requirements of pollutant emission concentration and emission, unorganized emission control and emission control in special periods. We will severely crack down on various illegal acts such as unlicensed and non-compliance with permits by "two high" enterprises, and timely expose typical cases of violating the pollutant discharge permit system.
5、 The implementation of safeguard policies has achieved results
(10) Establish management account. The ecological environment departments and administrative examination and approval departments at all levels shall establish the "two high" project management account, include the "two high" projects accepted and approved since 2021 and the "two high" projects listed in the plan by relevant departments, and record the project name, construction location, industry, construction status, acceptance time of environmental assessment documents, examination and approval department, examination and approval time, examination and approval document number and other basic information, If capacity replacement is involved, information such as replacement capacity, exit equipment and capacity shall also be recorded. The existing "two high" projects shall be reviewed according to relevant requirements. The "two high" projects are temporarily counted according to the six industry categories of coal power, petrochemical, chemical industry, iron and steel, non-ferrous metal smelting and building materials. If there are clear regulations on the scope of "two high" in the follow-up, those regulations shall prevail. The provincial eco-environmental department shall make overall arrangements for the "two high" projects in the administrative region, submit them to the Ministry of eco-environment before the end of October 2021, and update them every six months.
(11) Strengthen supervision and inspection. Local ecological and environmental departments shall establish a working mechanism for the supervision and inspection of environmental assessment and pollutant discharge permit of "two high" projects. For the "two high" projects that have been approved by the grass-roots ecological environment department and the administrative examination and approval department, the provincial ecological environment department shall carry out review. For those that have started construction and are under construction, we should focus on checking whether the ecological and environmental protection measures are implemented at the same time and whether there are major changes. For those that have been put into production or use, we should also focus on the implementation of ecological and environmental protection measures and requirements for reduction and substitution of key pollutants in areas proposed in the EIA documents and replies, as well as the application and implementation of pollutant discharge permits. Local ecological and environmental departments shall timely record the problems found in the supervision and inspection into the "two high" project management account. The Ministry of ecology and environment will further strengthen supervision and guidance.
(12) Strengthen accountability. The construction unit of the "two high" project should earnestly fulfill the main responsibility of ecological and environmental protection. For the "two high-tech" projects that start construction without submitting the EIA documents for approval according to law, or major changes without re submitting the EIA documents for approval according to law, the local ecological environment department shall order the construction to stop immediately and seriously investigate and deal with them according to law; Those who fail to meet the ecological environment access conditions shall be ordered to restore to the original state according to law. For the "two high" projects that fail to implement the requirements of environmental impact assessment and "three Simultaneities", they shall be ordered to rectify as required; If it causes major environmental pollution or ecological damage, it shall be ordered to stop production or use according to law, or it shall be reported to the people's government with the right of approval and ordered to close down according to law. If the staff of the examination and approval and supervision departments fail to perform their duties and check strictly according to law, they shall be punished according to law. If heavy losses or impacts are caused, the relevant responsible persons shall be investigated for responsibility according to law. If the local government fails to implement the ecological environment prevention and control measures of the "two high" projects and the problems are prominent, the regional approval restriction shall be implemented according to law and included in the central and provincial ecological environment protection inspectors.
