Chapter I general provisions



Article 1 in order to promote public agencies, improve public institutions energy efficiency, public institutions play in the leadership of the whole society, according to the energy conservation law of the People's Republic of China, these regulations are formulated.


Article 2 the term "public institutions" as mentioned in these regulations refers to state organs, institutions and organizations that use financial funds in whole or in part.


Article 3 the public institutions shall strengthen the administration of energy, take technically feasible and economically reasonable measures, reduce energy consumption, reduce and stop energy waste, effective and reasonable use of energy.


Article 4 the departments in charge of energy conservation under the state council shall be in charge of the supervision and administration of energy conservation in public institutions throughout the country. Under the guidance of the department under the state council's department of energy conservation, the agency responsible for the affairs of the administration of the state council shall be responsible for the promotion, guidance, coordination and supervision of the energy conservation work of public institutions throughout the country.


The departments under the state council and the local people's governments at or above the county level shall be responsible for the supervision and administration of the energy conservation of the public institutions at the corresponding level under the guidance of the departments in charge of energy conservation at the same level.


The competent departments at all levels, such as education, science, technology, culture, health and sports, shall carry out energy conservation work at the public institutions within the system under the guidance of the agencies at the same level.


Article 5 the state council and local people's governments at or above the county level administration affairs institution shall, jointly with relevant departments to carry out the public institutions at the same level of the propaganda, education and training in energy conservation, popularize scientific knowledge concerning water and energy saving.


Article 6 the heads of public institutions shall be fully responsible for the energy conservation work of the unit.

Article 8 the energy conservation work of public institutions shall be subject to social supervision. Any unit or individual shall have the right to report the waste of energy by the public institutions, and the relevant departments shall promptly investigate and deal with the reports.


Article 9. Units and individuals that have made outstanding achievements in the work of energy conservation in public institutions shall be commended and rewarded in accordance with the provisions of the state.



Chapter ii can be planned.

Article 23 the content of energy audit shall include:


(1) to inspect the completion and acceptance materials of buildings and the information of the system and equipment accounts, to check the implementation of the energy-saving design standards;


(2) to check energy consumption measurement records and financial statements of electricity, gas, coal, oil and municipal heat, and assess the total energy consumption, per capita energy consumption and energy consumption per unit of construction of the classification and sub-items;


(3) to inspect the operation status of energy systems and equipment and to review the implementation of the energy conservation management system;


(4) to examine the implementation of the reasonable use of energy recommendations in the previous energy audit;


(5) to find out the use energy link or part of the energy saving potential, and put forward Suggestions for rational use of energy;


(6) to examine the implementation of annual energy saving plans and energy consumption quotas, and to verify that public institutions exceed energy consumption quotas for energy use;


(7) to review the operation of energy measuring instruments and check the authenticity and accuracy of energy consumption statistics.



Chapter iv measures.

Article 28 the public institutions to implement energy saving transformation, energy audit and investment benefit analysis shall be conducted, the energy saving index, and after the energy-saving reform the measurement methods of energy saving assessment index system and comprehensive evaluation.


Article 29 public institutions shall reduce the power consumption of air conditioners, computers, photocopiers and other power equipment, and turn off the power equipment in time.


Article 30 public institutions shall strictly implement state regulations on indoor temperature control of air conditioners, make full use of natural ventilation and improve the operation and management of air conditioners.


Article 31 the elevator system of public institutions shall exercise intelligent control, properly set the number and time of elevator opening, and strengthen operation adjustment and maintenance.


Article 32 public institutions should make full use of natural lighting, office building with high efficiency and energy saving lighting lamps and lanterns, to optimize the design of the lighting system, improve the methods of control circuits, popularization and application of intelligent control device, strictly control the external building flood lighting and external decorative lighting.


Article 33 the public institutions shall carry out the key monitoring of the utilization of the network machine room, the canteen, the boiling water and the boiler room, and take effective measures to reduce the energy consumption.


Article 34 the official vehicles of public institutions shall be equipped according to the standards, and the vehicles with low energy consumption, low pollution and clean energy shall be preferred, and the vehicle scrapping system shall be strictly implemented.


The public institutions shall use official vehicles in accordance with the prescribed purposes, formulate regulations on energy-saving driving and implement the system of calculating the energy consumption of bicycles.


Public institutions should actively promote the socialization of official vehicle services and encourage workers to use public transport and non-motorized vehicles.



Chapter v supervision and protection.



Article 35 the organs of the state council and the local people's governments at or above the county level shall, together with the relevant departments, strengthen the supervision and inspection of the energy conservation of the public institutions at the corresponding level. The contents of the supervision and inspection include:


(1) formulation and implementation of annual energy saving targets and implementation plans;


(2) measurement, monitoring and statistics of energy consumption;


(iii) implementation of energy consumption quota;


(4) establishment of rules and regulations on energy conservation;


(5) the establishment of energy management posts and the implementation of the responsibility system for energy management;


(6) energy saving operation with energy system and equipment;


(7) to conduct energy audit;


(8) the equipment and use of official vehicles.


The public institutions that are not perfect in energy conservation regulations and have serious energy consumption exceeding the energy consumption quota shall be subject to major supervision and inspection.


Article 36 the public institutions shall cooperate with the energy conservation supervision and inspection, truthfully state the relevant information, provide relevant materials and data, and shall not refuse or obstruct.


Article 37 if a public institution commits any of the following ACTS, it shall be ordered to make corrections within a time limit by the agency working for the administration of the people's government at the corresponding level. If it fails to make corrections within the time limit, it shall be notified and shall be punished by the relevant authorities in accordance with the law:


(1) failing to set an annual energy saving target and implementation plan, or failing to record the annual energy saving target and implementation plan in accordance with the provisions;


(2) not shall practise a system of energy consumption measurement, can or can not distinguish with type, with system implements the household energy consumption, classification, itemized metering, and real-time monitoring of energy consumption situation;

(5) failing to make explanations to the organs of the people's government of the people's government at the same level if they exceed the energy consumption quota;


(6) failing to set up an energy management post or providing professional technical personnel in key energy-using systems or equipment operation posts;


(7) failing to carry out energy audits in accordance with the regulations or taking measures to improve the efficiency of energy utilization according to the audit results;


(8) refusing or obstructing the supervision and inspection of energy conservation.


Article 38 institutions does not perform government purchasing list of energy saving products, equipment, not in accordance with the provisions of the relevant national compulsory purchase or purchase procurement in the products listed in the list of energy saving products, equipment procurement, equipment, or purchasing declared obsolete by formal decree of the state of energy-using products, equipment, the government procurement supervision and regulation department to give warning, a fine may concurrently be imposed; The persons directly in charge and other persons directly responsible shall be punished according to law and shall be notified.

If a public institution starts to build a project without energy conservation assessment and review, the relevant organ shall order the rectification within a prescribed time limit. The persons directly in charge and other persons directly responsible shall be punished according to law.


Article 40 public institutions in violation of regulations for excess, extra purchase official cars, or refuses to scrap in energy intensive and highly polluting vehicles, the person in charge directly responsible and other directly responsible personnel given sanctions according to law, and by the administrative authorities of the people's government at the corresponding level affairs institution in accordance with the relevant provisions of the vehicle to take back, auction, and shall be ordered to return way.


Article 41 public institutions in violation of the rules can result in a waste of energy, by the administration authorities of the people's government at the corresponding level affairs institution jointly with the relevant departments issued energy conservation opinion, public institutions shall timely shall be implemented.


Of article 42 of the administration affairs agency workers in public institutions energy conservation supervision and administration of abusing authority, dereliction of duty, practice favoritism, if the case constitutes a crime, shall be investigated for criminal responsibility according to law; Those who do not constitute a crime shall be punished according to law.



Chapter vi supplementary provisions



Article 43 these regulations shall come into force as of October 1, 2008.
